Cairo Criminal Court, headed by Judge Moataz Khafagy, referred the Second Rafah Massacre's main defendant to the Mufti to take his opinion on the death sentence.
The judge adjourned the final ruling to November 14 in order to hear the Mufti's opinion, which is not mandatory by the court in accordance with Egyptian law.
The main defendant, Adel Habbara, and 34 other defendants are charged with killing 25 Central Security Forces recruits along the Arish-Rafah highway in August 2013.
The case is known as the Second Rafah Massacre.
The defendants are also accused of attempting to murder Central Security Forces in Belbeis and of spying for Al-Qaeda in Iraq.
Habbara had been sentenced to death in the same case and his challenge against the ruling was accepted by the Court of Cassation. His retiral along with the other defendants was set on September 8.
Habbara's lawyer objected to putting his client in the red attire assigned to defendants sentenced to death, saying the death sentence against Habbara was not yet confirmed.
